This article investigates the distribution of power in Poland’s drug reimbursement policy in the early 2000s. We examine competing theoretical expectations suggested by neopluralism, historical institutionalism, corporate domination, and clique theory of the post-communist state, using data from a purposive sample of 109 semi-structured interviews and documentary sources. We have four concrete findings. First, we uncovered rapid growth in budgetary spending on expensive drugs for narrow groups of patients. Second, to achieve these favorable policy outcomes drug companies employed two prevalent (...) methods of lobbying: informal persuasion of key members of local cliques and endorsements expressed by patient organizations acting as seemingly independent “third parties.” Third, medical experts were co-opted by multinational drug companies because they relied on these firms for scientific and financial resources that were crucial for their professional success. Finally, there was one-way social mobility from the state to the pharmaceutical sector, not the “revolving door” pattern familiar from advanced capitalist countries, with deleterious consequences for state capacity. Overall, the data best supported a combination of corporate domination and clique theory: drug reimbursement in Poland was dominated by Western multinationals in collaboration with domestically based cliques. The first complete translation of Shakespeare’s works into Russian, Levinas’s mother tongue, appeared between 1865 and 1868. These volumes doubtless graced the shelves of his family’s bookstore in Kovno (now Kaunas), in Lithuania, then part of the Russian empire. Kovno (...) served as capital of one of three губернии gubernias (provinces), but also as the de facto center of Lithuanian intellectual life. The family bookstore catered to the highbrow tastes of government officials and served the needs of teachers and students at the local lycée. One also imagines that it fired the literary imagination of the young Levinas, who taught himself to read Russian at a young age. However, it would have been highly unusual for one so young, even for one as precocious as Levinas, to have read Shakespeare recreationally and self-educationally during this period (1906–1915). It probably was not until he entered the lycée in Kharkov, in Tsarist Ukraine, where his family emigrated at the beginning the Great War, or after his family’s return in 1920 to Lithuania, where Levinas attended the Hebrew lycée in Kovno, that Levinas read Shakespeare for the first time. We know that Russian gymnasiums and technical schools assigned Shakespeare.1 His gymnasium education, between the ages of eleven and seventeen, is therefore the latest point by which Levinas could have read Shakespeare for the first time, though we do not know what or how much.He certainly acknowledged Shakespeare’s influence on his early thought. In an interview broadcast on Radio France Culture in February 1981, Philippe Nemo asked Levinas what were “the first great books” he encountered, “the Bible or the philosophers?” Levinas answered by saying that he read the Bible while very young but only began to read philosophy with any seriousness at university. He proceeded, however, to volunteer a third category of great books, [End Page 1]between the Bible and the philosophers, the Russian classics—Pushkin, Lermontov, Gogol, Turgenev, Dostoyevsky and Tolstoy, and also the great writers of Western Europe, notably Shakespeare, much admired in Hamlet, Macbeth and King Lear.2If we treat this as a chronology, then Levinas would have first read Shakespeare at some time “between” the age of six, when he began reading the Bible and other Hebrew texts with a private tutor, and the age of seventeen, when he enrolled at the University of Strasbourg.A polyglot, Levinas could have read Shakespeare in English as well as in Russian translation, but also in French, German, or Hebrew translation. The long agony of the mixed constitution that began in the civil wars which raged in Iberia, France, the Low Countries, and England and seemed settled by the widespread adoption of the maxims of reason of state, revived at the end of the period, with revolution in Poland, Denmark, Sweden, Geneva, and, more famously, [End Page 725] British North America and France. The problem, classically, turned on the location of sovereignty, or supreme authority, in political systems designed to balance and diffuse rather than concentrate power. When budget deficits and fratricidal culture wars raised the cry of “necessity”—with the knowledge, of course, that necessity knew no law—estates and kings across Europe found themselves at daggers drawn. The claim that the ruler, who naturally was wholly committed to the common good, had therefore the ability to take emergency action was used both by those accustomed to rule and those newly attained to it by force. The pursuit of an “interest” that was identified with the nation’s effectively marginalized discussions of right and law while still serving an essentially constitutional, justificatory role in political debate. But if unchecked authority was necessary in order to meet the challenge of a world characterized by change and chance and thus had to reside somewhere, was there anything that made its exercise by one body more appropriate than another? This was the question that lay behind the late eighteenth-century repudiation of the reason of state “solution” to the problem of the mixed constitution. The answer, which clearly underpinned the establishment in fact of what had first been theorized already a century earlier, was that only consent could legitimate the exercise of sovereignty in time of necessity.1Representation, in one form or another, was the acknowledged solution to the problem formulated by Hobbes: “the name of Tyranny, signifieth nothing more, nor less, than the name of Sovereignty, be it in one, or many men, saving that they that use the former word are understood to be angry with them they call Tyrants.” But representation also acknowledged the reality behind the charged category of “citizenship”: most people in most places could not be said to live the life of the active citizen celebrated in Roman republican literature. Hence Hobbes’s attack on recourse to classical exempla in general, and the Libertas of Lucca in particular. The idea of civis as law-abiding subject was as radical a redrawing of the terms of debate as the identification of human nature with unsociability. Insofar as politics, classically, justified itself as the means for individual self-perfection, the practice of the ancient citizen could be conceived of as the practice of that best life speculated upon by philosophers. For the represented citizen, however, politics necessarily occupied a more subsidiary position. Measurement of scientific productivity is difficult. The measures used (impact factor of the journal, citations to the paper being measured) are crude. But these measures are now so universally adopted that they determine most things that matter: tenure or unemployment, a postdoctoral grant or none, success or failure. As a result, scientists have been forced to downgrade their primary aim from making discoveries to publishing as many papers as possible—and trying to work them into high impact factor journals. Consequently, scientific (...) behaviour has become distorted and the utility, quality and objectivity of articles has deteriorated. Changes to the way scientists are assessed are urgently needed, and I suggest some here. (shrink)

Invoking three desiderata (empirical adequacy, conceptual precision, and sensitivity to social positioning), this paper argues that poverty is best understood as the deprivation of certain human capabilities. It defends this way of conceiving of poverty against standard alternatives: lack of income, lack of resources, inequality, and social exclusion.

This study examines business students’ individual values and their perception of their university’s values and the relationship between these values and affective organisational commitment. Findings indicate that both groups of business students rated their personal values as consistent with the rankings of the major pan—cultural values with strong ethical orientation and self—development and learning values. In both educational institutions organisational vision values and individual conservatism values predicted affective commitment. Findings also indicate statistically significant differences between the students’ personal values and (...) their perception of their university’s values, suggesting a degree of lack of P—O fit between the students’ values and their university’s values. The neoliberal-inspired “shock therapy” policies were designed to allow efficiency considerations to shape the new capitalist economies. Most experts theorized that these policies would enable postcommunist countries to close the gap with the West. After more than a decade, this prediction has been falsified. Fieldwork in 25 Russian firms demonstrates that the neoliberal prescription of mass privatization creates shocks that make successful enterprise restructuring almost impossible. Instead, most firms lower their technological level of production and retreat to nonmarket activity to (...) survive. The result is a poorer economy with less growth potential and thus increased divergence with the West. (shrink)

I frequently have trouble with words that other people use with what seems to be blithe understanding (friends tell me that the problem is that I think too much about words, but I find that not thinking doesn't really seem to help). In the case of `tolerance', though, I have no trouble at all - it's a wishy-washy weasel, a mealy-mouthed mink of a word. I suppose I don't want to claim that it has no decent place in the language (...) at all. I'm not particularly worried, for example, about our tolerating bad dramatic or musical performances by friends, close relatives, or children, nor about our tolerating the short tempers of those under great stress, and so on. What concerns me is the notion of tolerance that is so often to be found floating in the nebulous rhetoric of morality, both public and private. (shrink)

Both John Henry Newman and Vincent Gasser offered influential interpretations of the First Vatican Council’s teaching on infallibility. In contrast to many of theircontemporaries, Gasser and Newman placed papal infallibility alongside episcopal infallibility and the infallibility of the Catholic faithful. After exploring the views of Gasser and Newman, this essay compares their views to the Second Vatican Council’s teaching on infallibility in Lumen Gentium and concludes that even though Lumen Gentium cited Gasser, its theology is closer to Newman’s.

Our aim in this paper is to raise a question about the relationship between theories of responsibility, on the one hand, and a commitment to conscious attitudes, on the other. Our question has rarely been raised previously. Among those who believe in the reality of human freedom, compatibilists have traditionally devoted their energies to providing an account that can avoid any commitment to the falsity of determinism while successfully accommodating a range of intuitive examples. Libertarians, in contrast, have aimed to (...) show that either physical indeterminacy or a certain kind of agent causation can find a place in the world for what they take to be genuine freedom. Few have considered whether moral responsibility requires a commitment to conscious attitudes.2 Our question derives from a confluence of two sources. First, there is reason to think that conscious attitudes matter to theories of responsibility, either directly, as a result of the latter’s commitments, or indirectly, by virtue of the assumptions that they make about certain intuitive examples. Second, there is accumulating evidence suggesting that there aren’t any conscious mental states possessing the sorts of causal roles required of propositional attitudes. Since theorists of responsibility should in general be concerned to make their views compatible with plausible claims about the natural world, the implications of this data should be carefully considered. Our aim is therefore to motivate and begin exploring answers to the following conditional question: If it should turn out that there are no conscious attitudes, then what would be the implications of this fact (if any) for theories of responsibility? We propose that theorists who aren’t skeptics about moral responsibility should examine their accounts, asking whether their theories (or the examples that motivate them) could survive the discovery that there are no conscious judgments, decisions, or evaluations. Since we take it that moral theorizing in general should operate with the weakest possible empirical assumptions about the natural world, such theorists should consider whether their accounts could be motivated in such a way as to be free of any commitment to the existence of conscious attitudes.. The information‐transference account of teaching takes it to be a process in which information is transferred from one person's mind to another's. Augustine argues that this is impossible, since in order to understand something the person who understands must come to see why it is so, and that is an internal episode of awareness that isn't caused by an outside source. Augustine's insight here is contrasted with the contemporary view, following Wittgenstein, that learning is a matter of conformity to rules (...) (public norms). The case is made that teaching and learning pose philosophical problems that contemporary theories don't address, and a brief examination of Searle's Chinese Room example suggests that its plausibility derives from Augustine's insight that mere rule‐following behavior isn't enough to explain the phenomenon of understanding at the heart of knowledge. A reconstruction of Augustine's epistemological claims, divorced from his discredited views in the philosophy of language, is also provided. (shrink)

[1] In twelve quite demanding chapters, outstanding scholars provide an overall view of the key issues of Scotus’s philosophical thought. To this a very concise introduction is added, concerning the life and works of John Duns (very good, especially the survey of works and the information on critical editions etc.). Throughout the book, I find the information clear and the difficult topics well explained. Moreover, the volume gives a quick entrance to the vast literature. Among the topics discussed are: ‘Metaphysics’ (...) (Peter King), ‘Universals and Individuation’ (Timothy Noone), ‘Modal Theory’ (Calvin Normore), ‘Natural Theology’ (James Ross & Todd Bates), ‘Philosophy of Mind’ (Richard Cross), ‘Cognition’ (Robert Pasnau), ‘Moral Dispositions’ (Bonnie Kent). What strikes the eye is the absence of important theological subjects: Trinity, Christology, sin and grace, to name a few. Since the cover text promises that ‘the essays in this volume systematically survey the full range of Scotus’ thought’, this omission is remarkable. It stems, I guess, from the strict philosophical scope of the series of the Cambridge Companions, but such a limitation should have been recognised explicitly: this companion provides, in fact, an introduction to John Duns’s philosophy—i.e., philosophy in our modern sense. Of course, this separation of philosophical from theological thought is not from Scotus. Most of his innovative ‘philosophical’ ideas are developed in a profoundly theological context! (shrink)

Law is an essential tool for public health practice, and the use of a systematic legal framework can assist with preventing chronic diseases and addressing the growing epidemic of obesity.The action options available to government at the federal, state, local, and tribal levels and its partners can help make the population healthier by preventing obesity and decreasing the growing burden of associated chronic diseases such as cardiovascular disease and Type 2 diabetes. The Centers for Disease Control and Prevention uses the (...) four-part systematic legal framework commonly referred to as “public health legal preparedness” to demonstrate the essential role law can play for any public health issue. This paper uses the “laws and legal authorities” component of the framework and should be considered in combination with the competencies, coordination, and information-best practices components of the framework. I was born in Boston, Lincolnshire (actually in Wyberton West Hospital, which no longer exists), educated (if that's the word) first at St Mary's Primary School (run by nuns at the time, which probably explains a lot about my later career if you're a Freudian, which I'm not. Its new incarnation is here), then at Boston Grammar School . At the latter I successfully navigated 'O'-levels, but nearly half-way through my 'A'-levels I developed a number of extra-curricular interests which distracted (...) me from my studies. More importantly, I began to think rather more broadly than some of my teachers (and especially my appalling headmaster) cared for. This led to an almost total cessation of interest in my 'A'-levels. It did, however, involve a number of stage rôles at Blackfriars Theatre and elsewhere, and a good deal of time spent in the theatre bar. (shrink)

Peter Abelard is nowadays credited as the first philosopher to recognize the problem of existential import. I argue that he does not recognize our modern problem, and that his own take on the logical issues that are said to give rise to the problem is much more interesting and subtle than has usually been acknowledged, depending on claims in the philosophy of language that are worthy of investigation in their own right—in the end, vindicating Abelard’s claims about the traditional (...)
